Worst case scenario:

According to copyright law as I understand it:

* If something is not officially copyrighted, you can sue to have somebody stop using your material and not seek damages.

* If something is officially copyrighted, you can sue to have somebody stop using your material and seek damages. IE, they would say "Stop using our material and give us all profits you made." Since there won't be any profits, I assume that would end up... you know.... not a big deal.

* Unless they seek damages for money they WOULD have made had we not been selling it. But since there is no competing product.. you see where I'm headed.

(I guess that stupid comms law class had some sort of use... I can discuss legal issues regarding soccer onesies.)

Unless they go after CafePress because they are making money off of it and then CafePress comes after you because you knowingly used copyrighted material against their policy.

They could also sue if they feel that their brand has been damaged even if you don't make a cent. Not that they would, but you don't have to make a profit to have them come after you.

I guess if you guys want to risk it. It's not my neck on the line at all. I know I wouldn't touch it at all. I personally don't think it is worth the risk, but then maybe I'm just a pansy.

If Hiba does stuff with the RSL logo on CafePress, I'll let her take her chances on that. :D

If we want to do some original designs not including copyrighted work, I'll look into some local printers who could do them for us.

I think that would be awesome! I'd love to see more stuff, especially with the Loyalist logo on it. (If it's all right with McKid of course.) A Loyalist scarf would be just about the greatest thing ever. I'd really love one of those.

HiddnFox also has some cool Loyalist logo designs. Although I haven't seen Fox around lately...
Check out his profile to see the logo.

She specifically said the RSL logo. That's why he initially said to contact the front office. I really think he's ok with it for Loyalist purposes, but she could double check so everyone is ok with it.

If it was me, I'd just pay the MLS licensing fee and start selling RSL infant gear. But that's me. I know I would have to sell at a considerable markup just to cover the cost of licensing. I think this is a really good idea. If you start selling them by the tens of thousands, then I think the FO might have something to say about it. But I'd say you sell between 100 - 200 at best. Pastorino's probably thinking that it's not enough of a revenue to be a threat to RSL. Props on the great idea.
